General Terms and Conditions of Sale

PREAMBLE

These general terms and conditions of sale, hereinafter referred to as the "General Conditions", govern the terms of distance selling between any user of the www.23maiparis.com website wishing to make a purchase on the www.23maiparis.com website (hereinafter referred to as "the user") and the company ELG PARIS, whose registered office is located at 21 rue Spontini, 75116 Paris, FRANCE (hereinafter referred to as "ELG PARIS"). The company can be contacted by email by clicking on the contact form accessible via the website's homepage.

 

OBJECT

ELG PARIS’S MAIN BUSINESS ACTIVITY IS THE ONLINE SALE OF WOMEN’S AND CHILDREN’S CLOTHING ON THE WEBSITE WWW.23MAIPARIS.COM. THESE TERMS AND CONDITIONS ARE THE ONLY ONES APPLICABLE AND SUPERSEDE ALL OTHER TERMS AND CONDITIONS, UNLESS OTHERWISE EXPRESSLY AGREED IN WRITING IN ADVANCE. ELG PARIS MAY, AT ANY TIME, MODIFY CERTAIN PROVISIONS OF THESE TERMS. SUCH MODIFICATIONS TAKE EFFECT UPON THEIR PUBLICATION ONLINE AND WILL APPLY TO ORDERS PLACED AFTER SUCH PUBLICATION. ELG PARIS CONSIDERS THAT BY CONFIRMING THEIR ORDER, THE USER HAS DULY READ THE TERMS AND CONDITIONS AND ACCEPTS THEM WITHOUT RESERVATION.

 

PRODUCTS AND COMPLIANCE

The Products offered for sale are presented on the www.23maiparis.com website using descriptive sheets and photos with the greatest possible accuracy, but in some cases cannot ensure a perfect similarity with the product offered for sale, particularly regarding colors which may appear differently depending on the quality of the photograph or the color calibration on the screen. Consequently, these differences cannot in any case be interpreted as defects of conformity, lead to the cancellation of the sale, or incur the liability of ELG PARIS.

The essential characteristics of the goods and services, along with their respective prices, are made available to the user on www.23maiparis.com. Regarding sizes, the website allows for a margin of error of +/- 1.5 cm in the measurements of items; this is due to variations that may occur between different production runs at the factories. The user confirms having received details of shipping costs as well as the terms of payment, delivery, and contract fulfillment. ELG PARIS undertakes to fulfill the user’s order only to the extent that products are in stock. If not, ELG PARIS undertakes to inform the Customer in order to propose a solution.

PERSONALIZATION

ELG PARIS offers users the option to customize or have certain products embroidered on its website, www.23maiparis.com.

It is the user’s responsibility to accurately enter the chosen text and to verify the details to be embroidered when placing the order.
ELG PARIS will embroider the text on the products exactly as it appears on the order form.

Any personalized or embroidered items cannot be returned or refunded. Subscriptions also cannot be returned or refunded.

Any order error caused by the customer will not be returned or exchanged.

If, at the time of ordering, the customer forgot to specify a customization, or if the customization process takes too long, we will proceed to change the customization as indicated on the website.

Embroidered and/or personalized orders have a production time of approximately 7 business days, but this may take longer if our workshop is experiencing a heavy workload.

PRICE

All prices listed on the website include all taxes. Product prices are listed in euros. ELG PARIS reserves the right to modify its prices without notice, and the prices charged to the customer correspond to those displayed on the website at the time of the order. Customs duties, local taxes, import duties, or state taxes may be applicable in certain cases and/or certain countries. 
These duties and fees are not the responsibility of ELG PARIS. They shall be borne by the user and are the user’s responsibility (declarations, payment to the relevant authorities, etc.). ELG PARIS therefore encourages the user to inquire about these matters with the relevant local authorities.

The goods remain the full property of ELG PARIS until receipt of the total amount due paid by the user.

The prices indicated include order processing fees. The shipping and delivery costs applied are those indicated on the website at the time of the order.

 

PAYMENT

Customers can pay on the website www.23maiparis.com using a credit card (CB, Visa, AMEX, Mastercard) via the secure Stripe payment platform or through PayPal.

ELG PARIS entrusts the security of its transactions to the provider Stripe. Payment is secured through our partner Stripe's online payment system. Bank details are transmitted over the Internet only in encrypted form, meaning they are coded to be completely unreadable and are therefore never stored by ELG PARIS.

The user confirms that he or she is the legal cardholder of the card to be charged and that he or she is legally entitled to use it.
In the event of an error or if the card cannot be charged, the sale is immediately terminated by operation of law and the order is canceled.

ELG PARIS offers the option to pay in installments via the Alma platform; any issues related to this platform must be resolved directly between the customer and Alma.

 

DELIVERY METHODS

ELG PARIS ships its products within France and throughout Europe. Orders are processed within 48 hours, and delivery typically takes about 5 business days (unless otherwise stated on the website). Delivery times may be longer in special circumstances related to your order, such as embroidered or personalized items, pre-ordered products, or potential stock shortages. The risk of lost or stolen packages is the responsibility of the buyer once the products have left the ELG PARIS premises, and a tracking number will be provided to the customer. 

The delivery times listed on the website are estimates based on average processing and delivery times. To ensure these times are met, the customer must ensure that they have provided accurate and complete information regarding the delivery address. ELG PARIS cannot be held liable for any consequences resulting from a delivery delay that is not its fault, or if information was missing. ELG PARIS is also not responsible for the misconduct of logistics companies, which are external to our company.

If the company ships the wrong items, it is required to reship the correct item or issue a store credit on the website for the purchase price of the item. No refund will be issued until the customer has received the items.

If the delivery time is unusually long (maximum 15 business days after the package is shipped), the customer must contact ELG PARIS customer service as soon as possible at bonjour@23maiparis.com so that an investigation can be initiated with the carrier and appropriate action taken in the event of a lost package. We must follow our logistics provider’s procedure in order to subsequently refund you or reship your order. The maximum duration of the procedure is 45 days.

Every internet user is required to check the condition of the merchandise's packaging and its contents upon delivery of their order. In case of a claim regarding any defects or signs of product deterioration (missing product, damaged package, broken products, etc.), the internet user must note their observations on the delivery slip at the time of delivery, and then confirm them first by email with supporting photos to customer service at the following email address: bonjour@23maiparis.com

This also applies to the proper functioning of the T-shirt fasteners. We offer a 30-day warranty; after this period, defective items will not be exchanged or refunded. 

Please carefully check your delivery information before confirming your order. Once your order has been confirmed, our logistics system does not allow us to make any changes (address, products, size, quantity, or delivery method).

Once your order has been shipped, you will receive a confirmation email containing your tracking number, allowing you to track each stage of the delivery.

IMPORTANT! In the event of an incorrect or incomplete address, missing phone number, or any other information that prevents the package from being delivered, it will be returned to us. The customer will be responsible for the costs of returning and resending the package. 

This rule also applies to any package shipped to a pickup point and not collected within the time frame specified by the carrier.

If the package is returned to our warehouse, return and reshipping fees will apply; if you choose a refund, return fees will apply.

📦 Tracking & Delivery times

Please carefully check your delivery information before confirming your order. Once your order has been confirmed, our logistics system does not allow us to make any changes (address, products, size, quantity, or delivery method).

Once your order has been shipped, you will receive a confirmation email containing your tracking number, allowing you to track each stage of the delivery.

IMPORTANT! In the event of an incorrect or incomplete address, missing phone number, or any other information that prevents the package from being delivered, it will be returned to us. The customer will be responsible for the costs of returning and resending the package. 

This rule also applies to any package shipped to a pickup point and not collected within the time frame specified by the carrier.

If the package is returned to our warehouse, return and reshipping fees will apply; if you choose a refund, return fees will apply.

Shipping time :

  • Non-embroidered or non-printed products: shipped within 24 to 48 business hours.

  • Embroidered products: shipped within approximately 7 business days. Our workshop embroiders all garments at the time of order, so depending on our workshop's workload, orders may take up to 15 business days.

  • Children's products: shipped separately within approximately 3–5 business days.

👉 If your order contains both embroidered and non-embroidered/printed items, it will be shipped in one shipment once the embroidered items have been finalized in our workshop.

Premium delivery (DPD) : starting from 8,00 based on weight (delivery within 24/48 business hours) 
Chronopost Shop to Shop Relay: €4.50 (delivery times may vary depending on the pickup point chosen).
Next-day Chronopost delivery: €14.00 - Guaranteed delivery for all orders placed before 1:00 PM. This applies to deliveries Monday through Friday. If your order is placed on Friday, it will be delivered on Monday. If your order includes embroidered and/or personalized items, it will be shipped once the embroidery lead time has elapsed.

🔁 Returns & Exchanges

Non-refundable products :

  • All purchases of embroidered products, whether personalized or not, arefinal: no returns or exchanges

Reimbursable products :

  • Unprinted or unembroidered items may be returned within 14 calendar days of the delivery date. The customer is responsible for return shipping costs. A €4 return processing fee will be deducted from the refund. 

  • Items must be returned directly to our warehouse.We do notaccept returns dropped off at pickup locations. The customer is responsible for all return shipping costs.

  • Items must :

    • Be unwashed

    • Have their original labels and packaging

✅ Quality guarantee - 30 days: 

We take the utmost care in manufacturing our garments. Each garment comes with a 30-day warranty from the date of receipt covering any manufacturing defects.

After this period, no exchanges or replacements will be possible, even in the event of a defect.

We therefore invite you to check and try out your items as soon as you receive them, particularly the zippers, even if you do not plan to use them immediately, in order to ensure that they are in perfect condition within the warranty period.

Wear and tear resulting from use or washing does not constitute a manufacturing defect.

RETURNS AND REFUNDS

If the customer is not fully satisfied with the items ordered, in accordance with Article L. 121-20 of the French Consumer Code, “the consumer has a period of fourteen calendar days to exercise their right of withdrawal without having to provide a reason or pay any penalties, except, where applicable, for return shipping costs.” Return shipping costs are €4 per order and will be deducted from the final refund amount.

"The period referred to in the preceding paragraph begins on the date of receipt of the goods or on the date of acceptance of the offer for the provision of services."

We would like to inform our customers that, in accordance with Article L. 121-20-2 of the French Consumer Code, this right of withdrawal does not apply to any embroidered or personalized items.

To initiate a return, the user must first contact ELG PARIS at bonjour@23maiparis.com, specifying the reason for the return and their order number.

The customer must keep the proof of shipment provided by the postal service until the order has been refunded. If the package is lost, no refund will be issued.

We reserve the right to cancel customer orders without providing a reason or justification on the part of the company.

 

PERSONAL DATA PROTECTION

In accordance with the French Data Protection Act of January 6, 1978, you have the right to query, access, modify, oppose, and rectify any personal data concerning you.
All information in the user's account is used solely in the context of the commercial relationship with ELG PARIS.
This information is never shared with third parties or resold. Finally, the user's banking information is never in the possession of ELG PARIS.

 

INTELLECTUAL PROPERTY

The use of the website www.23maiparis.com is strictly reserved for personal use. All brands, texts, comments, works, illustrations, and images, whether visual or audio, including the underlying technology on the www.23maiparis.com website, are protected by copyright, trademarks, patents, and image rights. They are the full and exclusive property of ELG PARIS or its partners. Any reproduction or representation, in whole or in part, constitutes an infringement that may incur the civil and criminal liability of its author.

 

DISPUTE RESOLUTION

These general terms and conditions are subject to French law. Any dispute must first be subject to an attempt at amicable settlement.
In the absence of an amicable settlement, jurisdiction is assigned to the French courts, notwithstanding multiple defendants or the introduction of third parties.
